R. Kelly has cited public health laws in order to get herpes-related charges lifted and win his federal sex crimes case.
TMZ obtained fresh legal documents in New York’s Eastern District where the rapper filed a request to court to ditch charges for knowingly exposing sexual partners to herpes. Kelly highlights that the legislature excludes herpes in the law because it’s “not an acute, bacterial venereal disease.”
In March 2020, Kelly was accused by federal prosecutors of exposing two people to an STD with the American’s increasing list of federal charges after previously sexually exploiting underage girls and young women.
Within the new documents, Kelly’s legal team insist that herpes doesn’t fall under the STD category referenced to how the New York State Department of Health and World Health Organisation defines the term.
Herpes is classified as a virus, not a bacterial venereal disease, according to Kelly, who wants the herpes-related counts tossed.
Kelly is also facing a criminal trial in Chicago after allegedly grooming and molesting a 17-year-old man he met in McDonald’s.
