Lawsuit Over Childish Gambino’s “This is America” Dismissed

Federal court dismissed a lawsuit related to Childish Gambino’s outstanding 2018 hit “This Is America.”

 

The lawsuit was dismissed on Friday by U.S. District Judge Victor Marrero, who noted that Gambino’s song and Kidd Wes’ “Made in America” are “not substantially comparable” in their respective compositions, according to Billboard, which broke the story first. The choruses of the two songs are “entirely different,” the judge said.

 

Wes (actual name Emelike Nwosuocha) has accused Gambino and other defendants in the lawsuit of copying his music when the complaint was first made public in 2021. Wes claims that “Made in America” was posted to SoundCloud toward the end of 2016. The song “This Is America” by Gambino was published in 2018, but Fam Udeorji claims that it was first recorded in 2015.
